"America's Premier Lawyers Series"
Neil V. Getnick is the managing partner of Getnick & Getnick. He has coordinated numerous groundbreaking civil RICO, Federal False Claims Act qui tam and other civil prosecution investigations and litigations, as well as corporate monitoring and Independent Private Sector Inspector General (IPSIG) projects. In this interview, he addresses issues concerning pharmaceutical pricing (AMP/AWP) and the pursuit of justice for the public.
Neil’s civil RICO litigations have also included the first certified civil RICO class action, as well as the "Alliance" case heralded by Forbes for its "get-tough attitude" on an insurance fraud ring of corrupt lawyers, and the celebrated Tandem Computers mainframe computer parts theft case, described by The New York Times as a "real life 'Mission Impossible' in the heart of silicon valley." Every civil RICO case filed by Neil and his law firm since the firm's founding in 1983 has resulted in parallel criminal convictions of the principal named defendants, in addition to the securing of civil judgments.
Joanne M. Cicala is a highly distinguished attorney who concentrates on health care fraud and consumer litigation. Ms. Cicala has been with Kirby McInerney since 1997 and serves as Special Assistant Attorney General to the State of Michigan, Special Counsel to the State of Iowa, and counsel to the City of New York and forty three New York Counties, in connection with ongoing Medicaid fraud and false claims act litigations and other matters arising out of the health expenditures of these state and local governmental entities. In this interview, she offers her expertise about pharmaceutical pricing (AMP/AWP) and the need to protect the public.
Joanna represents and advises numerous public employee health benefit funds and Taft Hartley funds on an array of issues related to their health care expenditures and relationships with Pharmacy Benefit Managers. She is a member of the National Association of Public Pension Fund Attorneys and the County Attorneys Association of the State of New York. Prior to attending law school, Joanne worked for a US-AID funded organization in Washington, DC on legislative development projects in Central America. She also has extensive experience managing municipal welfare reform activities.
